Kentucky: Pro-Gun Bills See Action in Frankfort

This week, the following two pro-gun bills are expected to be heard in committee:

Tomorrow, February 11, House Bill 91 is scheduled for a hearing in the House Licensing and Occupations Committee at 9:00 A.M., in Room 169 of the state Capitol.  HB 91, introduced by state Representative James Kay (D-56), would clarify certain aspects of Kentucky’s charitable gaming statutes and afford groups, such as the Friends of NRA, the opportunity to host more events throughout the state.  HB 91 would also streamline the reporting process for those on the charitable gaming license.

Thursday, February 12, Senate Bill 67 is expected to be heard in the Senate Veterans, Military Affairs and Public Protection Committee at 9:00 A.M., in Room 169 of the state Capitol.  SB 67, introduced by state Senator C.B. Embry (R-6), would allow recognition of an NRA firearms safety and training course as a qualifying class when applying for a concealed deadly weapons license (CDWL).  By adding this NRA curriculum, SB 67 would allow citizens the option for training when obtaining a CDWL and would help ease the timeline, cost and process.

Please contact the members of the House Licensing and Occupations Committee and politely urge them to SUPPORT HB 91.  Please also contact members of the Senate Veterans, Military Affairs and Public Protection Committee and urge them to SUPPORT SB 67.  The contact information for the members of these committees can be found below.

Also recently introduced in the state Senate are Senate Bills 103 and 114.

Senate Bill 103, introduced on February 3 by state Senator Ray Jones (D-31), would create a special National Rifle Association license plate, with the extra costs for the license plate going toward the Eddie Eagle GunSafe Program.  This bill has been assigned to the Senate Transportation Committee but has not yet been assigned a hearing date.

Senate Bill 114, introduced on February 4 by state Senator John Schickel (R-11), would prohibit administrative regulations requiring concealed deadly weapon license applicants to clean their firearms in class. Instead, it would replace these requirements with instructor demonstrations.  SB 114 would also allow firearms safety instructors to issue certificates of completion rather than the Department of Criminal Justice Training.  This bill has been assigned to the Senate Veterans, Military Affairs, and Public Protection Committee but has not yet been assigned a hearing date.

Create a new section of KRS Chapter 237 requiring the office of the Attorney General to promulgate regulations related to the marketing, advertising, labeling, distributing, and sale of firearms designed to appeal to children; prohibit the sale of firearms designed with cartoon characters or designed specifically to appeal to children; forbid the marketing, advertising, or promotion of firearms designed specifically to appeal to children; provide that this section does not apply to BB, paintball, or pellet-firing air guns; enumerate that a violation of this section is considered an unfair, misleading, or deceptive act or practice in violation of KRS 367.170; provide that the remedies and powers given to the Attorney General under KRS 367.170 and the penalties under KRS 367.990 related to consumer protection apply to violations of the section; state that this section does not limit the powers and duties of the Attorney General under any other provision of law; and amend KRS 237.020 to conform.

Create a new section of KRS Chapter 237 to prohibit a person from selling a firearm, rifle, or shotgun at a flea market or gun show to any purchaser, unless the purchaser is licensed to carry a concealed weapon within the state of Kentucky or is licensed to carry a concealed weapon by a state that has entered into a reciprocity agreement with the state of Kentucky; prohibit a seller from conducting business with a purchaser who does not comply with the provisions of this section; require that the seller complete a form, approved by the Kentucky State Police, that identifies and confirms that the parties comply with the requirements of this section; require that information collected on this form be confidential and only available to a law enforcement officer of the Commonwealth when in the discharge of his or her duties; specify that this section does not apply to any seller who engages in the sale or transfer of less than five firearms, rifles, or shotguns in any calendar year at flea markets and gun shows within the state of Kentucky or to the sale or transfer of a firearm, rifle, or shotgun between spouses, children, or stepchildren within the same immediate family; provide that is a violation of this section for any person engaged in the sale or transfer of a firearm, rifle, or shotgun to leave the premises of the event in question solely to avoid compliance with the provisions of this section; require that a violation of this section shall be Class B misdemeanor.

Kentucky: CDWL Training Bill to be Heard Tomorrow by Senate Committee



Tomorrow, legislation dealing with changing the training requirements and easing the process for law-abiding citizens when obtaining their concealed deadly weapons license will receive a hearing in the Senate Veterans, Military Affairs and Public Protection Committee.

Senate Bill 114, introduced by state Senator John Schickel (R-11), would change the administrative regulations requiring concealed deadly weapon license applicants to clean their firearms in class before a certified instructor, instead shifting the responsibility to the instructor to demonstrate cleaning and proper procedure as a model example.  SB 114 would also allow firearms safety instructors to issue certificates of completion rather than the Department of Criminal Justice Training, expediting the issuance period and allowing law-abiding citizens to gain access to a concealed deadly weapons license much quicker.

Please use the information provided below to contact members of the Senate Veterans, Military Affairs and Public Protection Committee and politely request they vote in support of this commonsense reform for concealed deadly weapon license applicants.

Two additional pro-gun bills are awaiting final reading and a vote on the floor of their respective chamber, which are expected this week.

Senate Bill 67, introduced by state Senator C.B. Embry (R-6), would allow citizens more options for firearms training when obtaining a concealed deadly weapons license (CDWL) and would help ease the timeline, cost and process.  The Senate Veterans, Military Affairs and Public Protection Committee amended the original version of the bill to include language that changes firearms safety and training courses offered by the NRA to any national firearms organizations as qualifying classes when applying for a CDWL, and to add Kentucky concealed-carry law education to the new CDWL curriculum offered by a national organization.  This new national organization curriculum would run concurrent with existing Department of Criminal Justice Training (DOCJT) courses and would not alter any CDWL renewals or training standards currently in place offered by DOCJT.  Please contact your state Senator in support of SB 67.

Kentucky: Pro-Gun Bills Pass House Committee, Head to House Floor

Today, two pro-gun bills that deal with the concealed deadly weapons license (CDWL) training process passed favorably out of the House Judiciary Committee.  Senate Bill 67 and Senate Bill 114 will now be transmitted to the full House of Representatives for their consideration.  Please begin contacting your state Representative in support of these CDWL reform bills!
