And the SCOTUS Nomination Goes To...

Neil Gorsuch.

The Honorable Gorsuch, 49, is currently a judge on the US Court of Appeals in the 10th District. He is often referred to as an "originalist" and "textualist" when it comes to interpreting laws. Briefly, he believes that the Constitution should be interpreted as the Founding Fathers would have interpreted it, and that statutes should be interpreted literally. He is also described as a proponent of States' Rights over federal rights. His most famous case is the Hobby Lobby vs ACA case in which he ruled in favor of Hobby Lobby.

While he does not have a lot of opinions on the second amendment, he does have one criminal case under his belt. United States of America v Miguel Games-Perez in 2012, was a case were a felon owned a gun in a place where felons could not own guns. What was important in this case is that the felon did not know he was a felon at the time, which meant that the government needed to prove mens rea (meaning the government needed to prove he acted in a such way that he knew he was committing a crime).

What could also prove to be beneficial to the Second Amendment is that he things that the Chevron doctrine, which is from a 1984 case in which it was determined that the "courts must defer to permissible agency interpretations of ambiguous statutory language" (read:https://www.washingtonpost.com/news/volokh-conspiracy/wp/2016/08/24/should-chevron-be-reconsidered-a-federal-judge-thinks-so/?utm_term=.7c6accc19a31). Gorsuch wrote "...courts are required to overrule their own declarations about the meaning of existing law in favor of interpretations dictated by executive agencies."

The NRA was quick to endorse Gorsuch following his nomination. The NRA references an opinion (no source for where or when it came from) that Gorsuch wrote: "the Second Amendment protects an individual's right to own firearms and may not be infringed lightly."

NSSF Backs President’s Selection of Gorsuch for Supreme Court

Quote
The National Shooting Sports Foundation (NSSF), the trade association for the firearms, ammunition and related industries, tonight expressed its strong support for President Donald Trump’s nomination of Judge Neil Gorsuch of the U.S. Court of Appeals for the Tenth Circuit to become an Associate Justice of the United States Supreme Court.

“We are pleased to lend our support to President Trump’s nomination of Judge Gorsuch to the Supreme Court and urge the Senate to approve his nomination in as expeditious manner as possible,” said Lawrence Keane, NSSF senior vice president and general counsel. “We are confident that Judge Gorsuch will serve our nation with distinction as an Associate Justice of our nation’s highest court and that his service will do honor to the legacy of the late Justice Antonin Scalia in the protection of the Second Amendment rights of law-abiding Americans.”

SAF IMPRESSED WITH JUDGE NEIL GORSUCH FOR SUPREME COURT

Quote
The Second Amendment Foundation today said that Federal Judge Neil Gorsuch is an impressive choice to fill the vacancy on the United States Supreme Court, bringing with him a perspective on Constitutional rights that reflects strongly on the man he will replace, late Justice Antonin Scalia.

“We are delighted at President Donald Trump’s selection,” said SAF founder and Executive Vice President Alan M. Gottlieb. “Based on what we know and what others are saying about Judge Gorsuch, we can honestly say that there may not be a better candidate to fill the seat left vacant by Justice Scalia’s passing last year.

“We’re especially impressed with the fact that he has observed in a legal opinion that ‘the Second Amendment protects an individual’s right to own firearms and may not be infringed lightly’,” he added. “Judge Gorsuch definitely understands that firearms ownership is an American tradition, as noted in a case called United States v. Games-Perez.”

“President Trump has kept his word,” Gottlieb continued, “by nominating a superb high court candidate with an originalist approach to interpreting the Constitution, and particularly the Bill of Rights, as the Founders intended. We are eager to see him confirmed, and we are hopeful that he will enjoy smooth sailing through the confirmation process. After all, he was confirmed unanimously by the Senate when he was appointed to the Tenth Circuit Court.”

Judge Gorsuch has an impressive background, with a bachelor’s degree from Columbia University, a law degree from Harvard and a philosophy degree from Oxford. He served in the Justice Department under the George W. Bush administration.

“Antonin Scalia was a remarkable justice with a fine legal mind,” Gottlieb recalled. “It is our impression that Judge Gorsuch is cut from the same cloth. If he is confirmed by the Senate – and we see no reason why that should not happen – it is our expectation that Neil Gorsuch will prove himself to be a tremendous addition to the court, and among the wisest decisions in Donald Trump’s presidency.”

NRA Applauds Neil Gorsuch’s Nomination to the U.S. Supreme Court

Quote
The National Rifle Association (NRA) applauds the nomination of Judge Neil Gorsuch to fill Justice Antonin Scalia’s seat on the United States Supreme Court.

“President Trump has made an outstanding choice in nominating Judge Gorsuch for the U.S. Supreme Court. He has an impressive record that demonstrates his support for the Second Amendment,” said Chris W. Cox, Executive Director, NRA-ILA. “We urge the Senate to swiftly confirm Judge Gorsuch to the Supreme Court, just as it did in confirming him to the U.S. Court of Appeals for the Tenth Circuit by a unanimous voice vote.”

During his tenure on the Tenth Circuit, Gorsuch has demonstrated his belief that the Constitution should be applied as the framers intended.  To that end, he has supported the individual right to self-defense.  Specifically, he wrote in an opinion that “the Second Amendment protects an individual’s right to own firearms and may not be infringed lightly.”

“On behalf of our five million members, the NRA strongly supports Judge Neil Gorsuch’s confirmation to the U.S. Supreme Court. We will be activating our members and tens of millions of supporters throughout the country in support of Judge Gorsuch.  He will protect our right to keep and bear arms and is an outstanding choice to fill Justice Scalia’s seat,” concluded Cox.

2nd Amendment Groups' Statements on Gorsuch Nomination
« Reply #7 on: April 07, 2017, 09:16:39 PM »
NRA Statement on U.S. Senate Confirmation of Judge Neil Gorsuch

The National Rifle Association Institute for Legislative Action (NRA-ILA) today applauded the U.S. Senate’s confirmation of Judge Neil Gorsuch to serve as an Associate Justice on the United States Supreme Court.

“On behalf of our five million members, the NRA congratulates Neil Gorsuch on his confirmation to the U.S. Supreme Court,” said Chris W. Cox, executive director, NRA-ILA. “Gorsuch is an excellent choice to fill the vacancy left by the passing of Justice Scalia."

In the 2016 elections, voters made clear that the Supreme Court was an issue of critical importance.  Today, President Trump delivered on his promise of a constitutionally sound justice to fill the Scalia vacancy.

“The NRA would like to thank President Trump for fulfilling his campaign promise to place a pro-Second Amendment justice on the Supreme Court. Nominating Gorsuch has again demonstrated President Trump’s unwavering support for our fundamental right to self-defense,” Cox continued.

The U.S. Senate confirmed Gorsuch by a 54 to 45 vote. The NRA applauds Senate Majority Leader Mitch McConnell (R-TN), Senate Majority Whip John Cornyn (R-TX) and Senate Judiciary Chairman Chuck Grassley (R-IA) for their leadership in the confirmation of Neil Gorsuch.

SAF, CCRKBA Applaud Senate Conformation of Neil Gorsuch

The Second Amendment Foundation and Citizens Committee for the Right to Keep and Bear Arms today applaud the U.S. Senate for confirming Neil Gorsuch to the U.S. Supreme Court, thus restoring the high court’s full complement, and maintaining a philosophical balance important to upholding and enforcing the U.S. Constitution.

Gorsuch was confirmed on a 54-45 vote just before noon Friday.

“Judge Gorsuch demonstrated during two days of hearings before the Senate Judiciary Committee that he is eminently qualified to occupy the seat left vacant by the death of Justice Antonin Scalia last year,” said SAF founder and Executive Vice President Alan M. Gottlieb. “The court has been shy one critical vote and voice for more than a year. We are delight that time has come to an end.”

“President Trump kept his word to voters,” Gottlieb concluded, “by nominating a superb jurist with an originalist approach to interpreting the Constitution, and particularly the Bill of Rights, as the Founders intended.”

We assume that NSSF will have something to say, but they're usually a little behind with their statements.

It's about time.  What a stupid game that the dems played on this one.  They unanimously voted for him for the job immediately below this one and then they throw an apoplectic temper tantrum over this, and why?  Because the Republican Senate did the same thing that has always been done when a SCOTUS justice needs replaced on the watch of a lame duck president.  Ridiculous.

Now, when RBG gets tired of falling asleep on the bench or breaks a hip and can't show up for work, they need to get the conservative counterpart to the far lefties like the wise latina or  :o Kagen.  Someone a bit to the right of Genghis Kahn that loves of 2A rights bigly.

Agreed in the stupid game. Replacing Scalia with Gorsuch did not alter the balance of the court, they got a nomination of a man that was as close to Scalia as possible. The Dems first used in the so-called 'nuclear option' in 2013 when they had the majority to prevent filibusters on nominees (Thanks Harry Reid). They tried to change the Senate rules back then to have a simple majority, but they didn't have the 67 votes needed to change Senate Rules. This latest example of their hypocrisy just illustrates even more why Trump won. Reid set a new precedent with his actions. McConnell just built on it.

While I am hoping that Trump gets to nominate at least one more Justice, so we can see SCOTUS return to a neutral, non-activist, non-legislating court. But, I am bitter and would like to see a right-leaning Justice that is very pro-Second Amendment, pro-limits on the federal government... just all around, pro-Constitution.
